TERMS AND CONDITIONS

Please read this Agreement carefully. It governs your registration and participation in any products, programs, memberships, or courses (“Program,” “Membership,” “Journey,” or “Course”) offered by Global Guardian Services Pty Ltd ATF (“Company,” “we,” “our”) through The Mind Manual. By purchasing or using our services, you (“Client,” “Member,” “you”) agree to the following terms:

1. PROGRAMS AND SCOPE OF SERVICES

Weight Loss Without Willpower Program
This Program is designed as an educational resource, not medical advice. No medical monitoring or supervision is provided. You are strongly advised to seek medical clearance from your GP, endocrinologist, and other healthcare providers before beginning the Program. Ongoing clinical support should remain under the care of your medical team. Participation in the Program is at your own discretion and responsibility.
Definition of Diabetes Remission
For educational purposes, diabetes remission refers to your HbA1c (a measure of long-term blood glucose) remaining below 48mmol/mol or 6.5% for at least six months. This definition has been agreed upon by Diabetes UK, the American Diabetes Association, and the European Association for the Study of Diabetes (Source).

2. FINANCIAL OBLIGATIONS

You are responsible for completing all payments associated with your purchase.
Any unpaid balances may be referred to a collection agency for recovery.

3. PAYMENT METHODS

Accepted methods: PayPal, Visa, Mastercard.
If you choose an instalment plan, you authorise recurring charges to your selected card until the plan is complete.

4. REFUNDS

All refunds are discretionary and determined by the Company.
Refund requests may be denied if materials (e.g., PDFs, audios, videos, workbooks) have already been accessed or downloaded. This ensures fairness and protects against misuse.
Refund requests must be submitted to support@themindmanual.com.

5. CONFIDENTIALITY

1:1 Counselling and Coaching
Confidentiality provisions apply as outlined in our Privacy Policy.
The Mind Manual Community: This is a private membership portal where members may share personal or professional information. You are responsible for how much you disclose. You agree to keep information shared by other members confidential. While the Company will never sell or rent your personal information, we cannot guarantee confidentiality of information you voluntarily share in the Community.
Program Materials
All program content—including lessons, recordings, transcripts, and group calls—is confidential and for personal use only. Duplication, public posting, or redistribution is prohibited.

6. CLIENT RESPONSIBILITY

Our programs are for educational purposes only.
You are 100% responsible for your progress and outcomes. Results may vary widely.
The Company makes no guarantees of outcomes beyond any explicitly stated refund policy.

7. AUTHORISATION AND RELEASE

Participation in Programs (excluding private 1:1 sessions) may be recorded (audio, video, or still images).
You grant the Company full rights to use such materials for educational, promotional, and archival purposes worldwide, in perpetuity, without further compensation.
You waive any right to inspect or approve such recordings.
You affirm that any statements you make during participation are accurate and represent your genuine experience.

8. RIGHT TO REFUSE OR TERMINATE ACCESS

We reserve the right to suspend or terminate your access if you breach these Terms or act in a way that disrupts or harms the Program or community.
Upon termination, any outstanding payments remain due, and your access to program materials will be revoked.
Certain obligations—including confidentiality and intellectual property protections—survive termination.

9. COPYRIGHT AND INTELLECTUAL PROPERTY

All Program materials are original works of the Company and remain our exclusive property.
You are granted a single-user licence for personal use only.
You may not resell, republish, modify, or redistribute our materials.
Trademarked names, trade dress, and logos displayed on our site remain protected under Australian and international law.

10. LIMITATION OF LIABILITY

You use our services at your own risk.
The Company and its affiliates are not liable for damages (direct, indirect, incidental, or consequential) arising from your participation.
We make no warranty regarding errors, omissions, or completeness of materials.

11. NON-DISPARAGEMENT

You agree not to engage in conduct or communication that disparages the Company, its officers, staff, or members.

12. INDEMNIFICATION

You agree to indemnify and hold harmless the Company, its officers, employees, contractors, and affiliates from any claims, costs, or liabilities arising from your use of the Program—except where caused by Company negligence or misconduct.

13. INDEPENDENT CONTRACTOR STATUS

Nothing in this Agreement creates a partnership, joint venture, or employment relationship. Both parties remain independent contractors.

14. FORCE MAJEURE

We are not liable for delays or inability to perform caused by events beyond our control (e.g., natural disasters, strikes, government actions, or technical disruptions).

15. GOVERNING LAW AND DISPUTES

This Agreement is governed by the laws of New South Wales, Australia.
Disputes will first be addressed in good faith. If unresolved, disputes will be referred to binding arbitration through the Australian Centre for International Commercial Arbitration (ACICA).

16. MISCELLANEOUS

If any provision is deemed unenforceable, the remainder of the Agreement remains valid.
Modifications to these Terms may be made at any time and will be posted on our website.

17. ELECTRONIC AGREEMENT

By enrolling, purchasing, or participating, you acknowledge that your use constitutes an electronic signature, binding you to this Agreement with full legal effect.
